Three months after the Brazilian?s protracted transfer from Heerenveen to Middlesbrough, AZ have re-opened the Afonso Alves case and demand a 7.5-million-euros compensation fee on breach of FIFA rules.
The 27-year-old international striker had signed a contract with AZ on December 23 last year, but later changed his mind and ended up at Middlesbrough less than half-an-hour before the January transfer window closed.
AZ, who were prepared to pay Heerenveen some 20 million euros, filed for a KNVB arbitration, but lost the case on January 23, eight days before Alves completed a reported Boro record deal, somewhere between 15.2 and 17 million.
FIFA rules
But now AZ are demanding the former Atlético Mineiro and Malmö FF star to pay them 7.5 million in compensation for breaking his initial agreement to join them. ?We are claiming this amount of money on the basis of FIFA?s rules.? club lawyer Eric Vilé told ANP news agency.
Alves? new lawyer claims that the contract with AZ included a dissolving clause, article number 26, in case AZ and Heerenveen would not agree financial terms until January 31, while AZ insist that only they could appeal to that article.
Alves himself told the arbitration committee that the contract was invalid also because it wasn?t signed by his agent, which had also been his argument during the previous hearing, on January 28. The next hearing in Zeist has been set for May 19.
